ED Gets Nod To Prosecute Arvind Kejriwal, Manish Sisodia: The Financial probe agency Enforcement Directorate (ED) has received approval from the Ministry of Home Affairs (MHA) to prosecute Aam Aadmi Party (AAP) chief Arvind Kejriwal and former Delhi Deputy Chief Minister Manish Sisodia in the money laundering case linked to the now-scrapped Delhi excise policy.
The Ministry’s decision follows Delhi Lt Governor VK Saxena’s approval to prosecute the former Delhi Chief Minister in the case.
The latest development enables the investigation agency to frame charges against the former Delhi CM and his deputy, adding to their challenges ahead of the Delhi Assembly election on February 5.
The trials could begin once charges are framed against Kejriwal, making it more difficult for him to return as the Delhi CM.
In a ruling last November, the Supreme Court stated that the Enforcement Directorate must obtain prior sanction before prosecuting public servants.
The next month, the investigation agency sent a letter to the Lt Governor, arguing that sanction should be granted as Kejriwal is the “kingpin and key conspirator” in the scam.
In response, the AAP chief approached the Delhi High Court, claiming that the chargesheet filed by the probe agency against him and others is illegal, as no prior sanction from the authorities was obtained before submitting the prosecution complaint.
